Busted for a pipe and ... Posted: Fri Nov 06, 2009 5:32 pm |

Some posts ago I recommended to someone who was busted for a pipe that the person should self represent and request a jury. The reason for this is that the charge will most likely get dropped.
I just heard from another person today that his pipe charge got withdrawn by the prosecutor when he self represented and requested a jury (and it was the only thing he was charged with). This is the 3rd time he has done this! Hat-trick! |

That must be one of the stupidest laws this country has, can't get you for the illegal substance so bust you for the utensil used with the illegal substance.
Can't remember who introduced that law.
It's perfectly legal to sell pipes but it isn't until it is used with cannabis that it becomes a cannabis utensil. _________________ A pain free day the marijuana way.

^One could smoke 'hash oil' out of what might be called a 'P-pipe' - or you could smoke tobacco out of it. What is it but a piece of glass?
MrNiceGuy - I believe it was the Shipley regime which passed a law banning pipes for/associated with cannabis use, whether they have been used or not. It seems that while there has been the odd confiscation by customs of alleged cannabis pipes, they are being sold as always and the law was a waste of time. Why? Because any pipe can be used as an ornament or to smoke tobacco. |

| Why was I under the impression that the 1999 possession of a weed pipe notice had been revoked and replaced by the 2003 ban on importing specific utensils? Or am I misinterpreting that revokation notice? |

If you go to a shop that sells similar equipment you will notice they don't use the names above to describe their products so as to be able to sell them.
The products they sell are for the legitimate products but can be used for illegal purposes too.
It isn't until the are used with the illegal substance that they become a cannabis utensil. _________________ A pain free day the marijuana way.

| I can see how most stores get away with selling bongs as "vases" but ive always wondered what they are selling the stem and cone piece as? all I know is that its legal to purchase them separately but not together, or so most stores say. |

Haha... I'm with "mgen"... Hypothetically speaking, if I ever were to have a pipe, then that pipe would only ever be used to smoke tobacco with.
If it was a "vase" then the only thing going in there would be water for my daisy... Hypothetically speaking of course |
